Charges were dropped by the prosecutor because the prosecutor decided not to prosecute the defendant without probable cause to believe that a crime had been committed. That represents a complete failure of our system of justice.
It was the Constitutional duty of the magistrate who issued the arrest warrant to dismiss the charges upon the application for a warrant. There was not sufficient evidence for a magistrate to reasonably believe that the prosecutor reasonably believed that the killing was an unlawful act, and an act that is presumed lawful by our Constitution, an act that is expressly permitted by the law or excused by the grace of the law, cannot be unlawful and therefore cannot serve as the actus reus of a criminal offense.
The bodega worker’s clearly established Constitutional right not to be arrested, charged, and prosecuted without sufficient evidence for probable cause to believe a crime was committed was violated by the prosecutor and the magistrate. The bodega worker needs Benjamin Crump and the American Civil Liberties Union to help him enforce his rights.
