CHAPTER 400 JUSTIFICATION

400.16 Deadly Force – General Statement

The term “deadly force” means:

1. Force used to cause [a disabling mental illness] [a bodily injury which creates a substantial risk of death] [a bodily injury which causes serious permanent disfigurement] [a bodily injury which causes protracted loss or impairment of the function of any bodily member or organ].

2. Force the defendant knows or should reasonably know will create a strong probability that (serious injury)* will result.

3. Discharging a firearm in the direction of someone, knowing they are present, even though there is no intent to cause a serious injury.*

4. Discharging a firearm at a vehicle in which someone is known to be.
