8.07C1 EXCEPTIONS TO INTRUDER PRESUMPTIONS INVOLVING HOME AND HABITATION
You are instructed that the presumption contained in Instruction 8.07B shall not apply if you find that the person against whom the defensive force is used [has a right to be in] [is a lawful resident of] a home or habitation and there is not [an injunction for protection from domestic violence] or [a written pretrial supervision order of no contact] against that person.

Use Note (2009):
§ 6-2-602 gives a non-exhaustive list of lawful residents as an owner, lessee or title holder; however, the statute does not limit the term lawful resident to these persons. The exception outlined herein should only be instructed upon if there is an issue presented in the evidence as whether the presumption applies.
