DEFENSES
No. 1114 – Defense–Use of Physical Force in Defense of Property
The defense of defense of property has been raised.
A person is justified in using physical force, but not deadly physical force, on another person when and to the extent that [he / she] reasonably believes it is necessary to prevent/ terminate the commission/ attempted commission of theft/ criminal mischief.
The burden of proof is on the state to prove beyond a reasonable doubt that this defense does not apply.
