DEFENSES

No. 1107 – Defense–Physical Force–Defense of Person

The defense of self-defense/ defense of another person has been raised.

A person is justified in using physical force on another person to defend self-defense / defense of another person / himself from what [he / she] reasonably believes to be the use or imminent use of unlawful physical force. In defending, a person may only use that degree of force which [he / she] reasonably believes to be necessary.

The burden of proof is on the state to prove beyond a reasonable doubt that the defense does not apply.
