CHAPTER 3 ASSAULTS AND RESTRAINTS OF PERSONS

§ 3.12A Deadly Weapon
[KRS 500.080(4)] [Wilburn v. Commonwealth, 312 S.W.3d 321 (Ky. 2010)]
“Deadly weapon” means:
[any weapon of mass destruction]
[any weapon from which a shot, readily capable of producing death or other serious physical injury, may be discharged] [[, including any such weapon that is unloaded or incapable of discharging, so long as it otherwise belongs to a class of weapons satisfying this meaning of “deadly weapon.”]] See KRS 500.080(4)(b) and Wilburn v. Commonwealth, 312 S.W.3d 321 (Ky. 2010). The double bracketed language is used when the evidence affords an inference that the weapon might have been unloaded or inoperable.
