GEORGIA SUGGESTED PATTERN JURY INSTRUCTIONS (SPJI 2013)

GA SPJI 2.10.20  Felony Murder; Defined

A person (also) commits the crime of murder when, in the commission of a felony, that person causes the death of another human being (with or without malice). Under the laws of Georgia [specified offense] is a felony and is defined as follows:

If you find and believe beyond a reasonable doubt, under all of the evidence and the court’s instructions, that the defendant is guilty of the offense of murder with malice aforethought, then you must specify such in your verdict, and the form of your verdict in that event would be, “We, the jury, find the defendant guilty of malice murder.”

If you find and believe beyond a reasonable doubt, under all of the evidence and the court’s instructions, that the defendant is guilt of the offense of felony murder, then you must specify such in your verdict, and the form of your verdict in that event would be, “We, the jury, find the defendant guilty of felony murder.”
