Amber Guyger Sentenced to 10 Years

Just a quick note: It appears that Amber Guyger, just convicted of murder in the “wrong apartment” shooting death of Botham Jean, has been sentenced to 10 years in prison. It seems to me that on the law and facts murder was the wrong conviction in this case, and some form of manslaughter would have been more appropriate if the “reasonable mistake self-defense” was not going to be accepted as grounds for an outright acquittal. …

GUILTY! Amber Guyger “Wrong Apartment” Shooter Convicted of Murder

Just a quick update on the Amber Guyger “Wrong Apartment” murder case, as we have a verdict: The jury has convicted Guyger of murder, as charged. From CNN, reporting a few minutes ago: A jury has found former Dallas police officer Amber Guyger guilty of murder, the judge announced Tuesday. Guyger was indicted last year after fatally shooting her unarmed neighbor, Botham Jean, in his own apartment, which she said she mistook as hers. There …

REPOST: “Wrong Apartment” Shooting 911 Recording

NOTE:  This blog post was originally published on June 12, 2019.  Given the timeliness of the content, however, and with the “wrong apartment” case going to the jury for deliberations, I thought it appropriate to republish it here today. Today’s Post of the Day takes a listen to the leaked 911 call made by former Dallas cop Amber Guyger immediately after she shot and killed Botham Jean when she mistakenly walked into his apartment thinking …

Decisive Evidence in “Wrong Apartment” Murder Trial Points to Acquittal

The “wrong apartment” murder trial will shortly be heading to the jury. This is the case in which then-LEO Amber Guyger entered what she claims she believed was her own apartment, encountered Botham Jean who actually was in his own apartment, and shot and killed him in claimed self-defense against a perceived intruder. Today I note that what should be the most important and decisive evidence—indeed, the only evidence that really matters—in the case was …

Murder? Man Returns to Bed After Killing Thief

James Michael Meyer, a 72-year-old Dallas man, returned to bed after shooting and killing a purported thief this past week, before later calling police He’s now been charged with murder. While Meyer going back to bed is bizarre behavior that leads every headline on this story, is it the major evidence supporting a murder charge? Are there other facts in this case that undermine his claim of lawful self-defense and (likely in Texas) deadly force …

The Closing Window of Imminence

A Bronx man comes across a burglar breaking into his house. The homeowner brings deadly force against the burglar—a use of force explicitly permitted under New York law. The burglar dies as a result. Now the homeowner is charged with murder! Wondering how the homeowner could be charged with the murder of the burglar when New York law explicitly allows for the use of deadly force to stop a burglary? Ready to hear the rest …

Calling the Shots: September 25, 2019

Today’s post is a replay of yesterday’s live recording of our self-defense law analysis program, “Calling the Shots,” hosted by Alien Gear Holsters. We’re continuing our new approach of analyzing the legal dynamics of use-of-force events captured on video. If you’re listening to this on podcast, we also make an effort to verbalize what’s happening in the video, but naturally watching the video of this post is probably the best way to go. If you …

VIDEO: “Knife Up, Don’t Shoot”?

This past September 17, a white Saint Paul MN police officer shot and killed a black male, Ronald Davis.   Within five days there were organized protests against police brutality, complete with professionally printed signs and “Stop Killing People of Color” banners. This is how that shooting was described by “news” (actually propaganda) source that self-identifies as focusing on “the People’s Struggle”: 31-year-old Ronald Davis was a father, recently married, and had just graduated school. After …

Shotgun Booby-Trap: Just Don’t

The notion of booby-traps has been around for as long as human beings have wanted to secure their unattended stuff against unlawful taking. Indeed, although we didn’t spend much time in law school studying use-of-force law generally, some of our memorable case discussion involved the use of deadly-force booby-traps in defense of property specifically. Now out of Illinois we have a case of a man who was tried, and convicted, of murder because a shotgun …
