POTD: If Gun Control Fascists Didn’t Have Lies …

Those of you who have been members of the Law of Self Defense community for any length of time have heard me make this observation innumerable times: “If the gun control fascists didn’t have lies, they’d have nothing to say at all.” Today’s Post of the Day reaffirms the simple truth of this observation in a blog post about Arkansas continuing efforts to adopt “Stand-Your-Ground” (aka, no legal duty to retreat before defending yourself if …

POTD: Self-Defense Immunity Advances in Indiana, Tennessee

This Post of the Day is on efforts to adopt self-defense immunity laws in Indiana and Tennessee. I’m a huge fan of self-defense immunity laws, primarily because they provide an alternative means of arguing self-defense justification in a pre-trial setting that is far less costly and far quicker than a full-blown trial. This can really mitigate the risks of the legal process itself being used as the punishment in cases where self-defense is a robust …

POTD: The Key Factor is Force, not Gender, Age or Numbers

COTW: Regaining Innocence: Real-World Example

This Case of the Week focuses on a real-world example of the application of the self-defense law doctrine of “regaining innocence.” VIDEO: AUDIO:   One of the five elements of a claim of self-defense justification for a use-of-force against another person is the element of innocence, which denies the justification of self-defense to a person who was the initial aggressor in a fight. “Initial aggressor” generally means the person who was the first to threaten …

POTD: Zombie-like False Self-Defense Narratives Never Die

I’ve written extensively about the false narratives created around a great many legitimate cases of self-defense—mostly notably, perhaps, the justified shooting death of Trayvon Martin by George Zimmerman, a case in which there was literally zero evidence inconsistent with Zimmerman’s innocence. Despite the indisputable and objective falsity of these narratives, however, once created they seem to continue to “live” forever, in Zombie-like fashion, completely immune to actual fact and reality. Today I came across a …

COTW: Setting an Ambush: Are the Stakes Worth The Risks?

This Case of the Week involves an Indianapolis man who successfully ambushed three home burglars, killing one and driving off the others, who were ultimately arrested.  (Click here for a link to the news report.) Local prosecutors have announced that they do not intend to bring charges against the defender.  Based on the reported facts this appears to be a perfectly sound call by prosecutors.  So, a big win for the good guy, right? …
