Law of Self Defense Institute

In the interests of advancing our mission of educating American citizens on their rights and obligations in acting in defense of themselves, their families, and their property, I’m proud to announce that in addition to our books and seminars we are launching the totally free “Law of Self Defense Institute.”

The Law of Self Defense Institute consists of selected instructional materials presented in video and audio format. Instructional videos will consist of slide presentations with voiceover to illustrate some particular facet of the law of self-defense, and some interesting application of self-defense law or court decision that I’ve come across, or replies to questions sent in to podcast@lawofselfdefense.com. Instructional podcasts are simply the audio tracks of the videos, but in a format more amenable to use while driving, exercising, etc. Both will be published on more or less a weekly basis.

This video lecture analyzes the February 11, 2015 decision by a federal district court in Texas that the requirement of the Gun Control Act of 10967 that all interstate handgun transfers much go through an FFL in the state of residence of the recipient is unconstitutional. Interestingly, the court found the federal handgun transfer ban an unconstitutional infringement of the Second Amendment under both strict scrutiny and intermediate scrutiny, and an unconstitutional infringement of the Fifth Amendment right to Due Process under strict scrutiny. This decision strikes at the very heart of the GCA of 1968 FFL framework, and bodes ill for any other gun law examined under strict scrutiny.
