CHAPTER 400 JUSTIFICATION

400.9 Knowledge Of Forcible Felony Being Committed

Concerning element number 1 of Instruction No. ____, whether the defendant knew (name of forcible felony) was being committed by (name of victim) means [he] [she] had a conscious awareness of it. This is to be determined from all of the facts and circumstances.

It is not necessary that (name of victim) was charge or convicted of (name of forcible felony). It is only necessary that the defendant knew that (name of victim) was committing it.
